General Terms and Conditions
1. Scope
The following Terms and Conditions apply to all orders placed through our online shop.
2. Contracting Party, Conclusion of Contract
The purchase contract is concluded with Scitch-GmbH.
By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive another confirmation by email.
3. Contract Language, Storage of Contract Text
The language available for concluding the contract is German.
We do not store the contract text.
4. Delivery Conditions
In addition to the stated product prices, shipping costs will be added. You can find more information about the amount of shipping costs with the offers.
We only deliver by shipping. Self-collection of goods is unfortunately not possible.
We do not deliver to packing stations. We deliver throughout Europe.
5. Payment
The following payment methods are generally available in our shop:
PayPal Checkout
As part of the PayPal Plus payment service, we offer various payment methods as PayPal Services. You will be redirected to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal, and the payment instruction to PayPal.
If you have chosen PayPal as the payment method, you must be registered there or register first and legitimize yourself with your access data to pay the invoice amount. The payment transaction will be carried out automatically by PayPal immediately after confirmation of the payment instruction. Further information can be found during the ordering process.
If you have chosen credit card as the payment method, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment instruction and your legitimation as the rightful cardholder by your credit card company at PayPal’s request, and your card will be charged. Further information can be found during the ordering process.
If you have chosen direct debit as the payment method, you do not need to be registered with PayPal to pay the invoice amount. By confirming the payment instruction, you issue a direct debit mandate to PayPal. PayPal will inform you about the date of the account debit (so-called prenotification). Upon submission of the direct debit mandate immediately after confirmation of the payment instruction, PayPal will request its bank to initiate the payment transaction. The payment transaction will be carried out and your account will be debited. Further information can be found during the ordering process.
6. Retention of Title
The goods remain our property until full payment.
7. Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the delivery person immediately if possible and contact us without delay. Failure to report or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
8. Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The limitation period for claims for defects for used goods is one year from the delivery of the goods.
The above limitations and reductions of periods do not apply to claims for damages caused by us, our legal representatives, or vicarious agents
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty as well as malice,
- in case of breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner can regularly rely (cardinal obligations)
- within the scope of a guarantee promise, if agreed, or
- insofar as the scope of the Product Liability Act is applicable.

9. Liability
For claims for damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in case of guarantee promises, if agreed, or
- insofar as the scope of the Product Liability Act is applicable.
In case of breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner can regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of contract conclusion, which must typically be expected to occur. Otherwise, claims for damages are excluded.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/.
We are willing to participate in out-of-court dispute resolution proceedings before a consumer arbitration board.
The General Consumer Arbitration Board of the Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de, is responsible.
